This sounds like a great opportunity for you to avoid deactivation! But keep in mind that you need to be well prepared and speak perfect English.

You can take Amazon to court only if you have deep pockets

Hello Amazon Seller Support Team.

I hope this email finds you in the best of health and spirit.

My name is Muhammad Shams ul Haq and my storefront on Amazon is ā€˜ā€™Super Steal Deals.’ I created this account in June 2022 and I have completed 350+ orders on Amazon. My account health is 204 and it has never been deactivated in any TOS violation.

On 1st September, 2023, I received an email which stated that my account was under review in accordance with section 3 of Amazon’s Business Solutions Agreement. The reason it mentioned was this, ā€˜ā€™ your account or a related account is engaged in sales of counterfeit inventory which violates intellectual property rights, and may have been used to engage in deceptive or illegal activity that harms customers and our store. To learn more please refer to section 3 of the Amazon Services Business Solutions Agreement.’’

It asked me to provide the following documents related to two brands:

  1. Herko Automotive
  2. ALASTIN skincare

–Business registration documents which include full name, address, signature, etc.
– Invoices and receipts which include item descriptions and quantities. You may remove pricing information, but the rest of the document must be visible.
– Supplier information including the supplier’s name, supplier phone number, supplier address, and website for the following Shipment:
–Proof of delivery by the carrier
–Bill of lading
– Import and export documents commercial invoices, , export origin location (port city), import destination location, brand information, quantity, date, buyer information, import and export manifest (and information submitted to Customs and Border Patrol
– Authorization letters from brands and licensed brand distributors.

Explanation regarding Brands

Herko Automotive:

This Brand has never been sold through our Seller Central. This email is the first time our team has heard of it. We have never been in possession of any SKU of this brand. We have not purchased any units from any source to resell on Amazon.

Alastin Skincare:

In April 2023, we created a listing of an SKU of this brand to check if our Seller Central was eligible to sell this item. We did not use this listing to sell any units of ā€˜ā€™ALASTIN skincare.’’

The sole purpose of creating this listing was to check if our account could sell in the beauty category, because we had never sold in this category.

As our account sales numbers were not enough, we couldn’t list it and henceforth, we did not purchase any inventory from Authorised distributors and the brand itself.

Our Amazon Seller Central was never used to sell these items in ā€˜ā€™New, Used, Used like New Conditions. Amazon did not allow us to submit invoice (Image 1), so we never purchased inventory from brand to sell on Amazon

To summarise, our product listing creation strategy looks like this:

  1. Check if the product listing can be made on Amazon
  2. Check for category restrictions
  3. If the product listing is created and there are restrictions, contact the brand and authorised distributors to purchase inventory.

Even to this day, we cannot list any Alastin Items, we can’t even submit invoices. I am attaching ā€˜ā€™Image 1’’ which shows that we have no option of submitting an invoice. Therefore, we never purchased any inventory from the distributor/brand and never sold any SKUs of ā€˜ā€™ALASTIN skincare’’ on Amazon.

For these reasons, we urge the Amazon Seller Support team to show us leniency and clear our accoun’s section 3 review.

Recently, a customer raised a ā€˜ā€™product inauthenticity’’ complaint for the ASIN B09WZ9QL46 for which we submitted the invoice to Amazon within 1 day.

We will revise our product listing creation methodology and make sure our account health increases even more than 204 which started from 200 and never, once, fell below 200.

In accordance with our compliance with Amazon TOS and maintenance of policies while selling on Amazon, I request you to allow us to continue our selling journey on Amazon.

I’m attaching the following documents:

–Valid ID proof document that includes full name, date of birth, ID number, expiry date, signature of the bearer (if applicable) and country of issuance or country of citizenship.
–Bank statement or credit card statement issued in the last 180 days which includes full name of the individual or of the business, residential or business address, bank information.
–Business registration documents which include full name, address, signature, etc.

I think that this is a very solid appeal. I would advise you to call the Account Health Team again and open a case where you will post this appeal for them to review it prior to submitting it.

I have checked and read the whole conversation… the appeal is well draft. You should submit it and go for the interview session. But there is only thing to be notice that in Alastin skincare listing should be tackle in much more soft wordings in appeal. As the policy matters should be first consulted before listing. Otherwise it is fine.

Should It be like this…

Our team’s newest hire made the mistake of creating listing of ā€œAlastin Skincareā€ prior to contacting the brand and it’s authorized distributors.

I personally will ensure that such irresponsible and reckless mistake. won’t happen again.

We have started evaluating our who listing creation process to make it 100% compliant to Amazon policy.

Yes but it needs bit working on it… you have to mention the name of the inventory manager.

And what precautionary steps you will take in future to avoid it.

@Akmal Should I attach personal account statement or business account statement?

My personal wise account is attached to Amazon. It is under my own name and it’s based off my residential adress.

My business account is not attached to amazon. However, it is under my LLC name and the address is the same which was used for LLC registration.

Should I go with both?

Would it be wise to attach EIN document for further proof of identity?

As expected, Amazon has deactivated my account for Section 3 violation. I don’t think they even read my appeal.

I am very sorry to hear that. Have you engaged in the video call verification? How did it go? What did they ask you and what did you provide them?

Maybe @Akmal can add some insight, he is based in Pakistan and routinely assists with cases like this.

I have been scammed once by an Account Specialist.

The other which are experienced are too expensive for my budget.

So now my business has gone downhill.
