Need advise about restriced product

Hello,
We receive a notification about a restricted product that we sell in Amazon.fr, because of CBD. We have COA (Certficate of analysis issued in 09.2020) for the product and there are no information about the content of CBD. There are 4% Cannabis Sativa Seed Oil - I am not sure but i think that this is different active ingredient.

We need advice how to proceed, is this document ENOUGHT to show on amazon team that this item is permited for sale or it is better to write a PoA and say that we made a mistake and stop selling it ?

If we try to show them that this is is permitted for sale and they ask for additional documents we are unable to upload.

I know nothing about CBD however I checked the relevant policy. I only looked at amazon.co.uk but there may be on .fr.

I also researched cannabis sativa see oil which I also know nothing about. My frienf google states:

" It’s one of more than 100 chemical compounds called cannabinoids that are found in the cannabis plant, Cannabis sativa.“. Also " Cannabis Sativa Seed Oil is extracted from Hemp and used in skincare formulas. Since it is extracted from the seeds of the plant, Cannabis Sativa Seed Oil contains less than 0.3% THC making it non-psychoactive.”

I can’t advise any further so I hope I have given you some guidelines for you to do more research. Good luck.

No, CBD products are definitely restricted / prohibited from sale.

Do you have the ASIN ?

They remove the listing so it is not visible.

Thank you very much. Maybe I wont try to proof them that it is not restricted, 3-4 sales for 3 months. Hope to save the account :slight_smile:

Could you post here the notification from Amazon which you received, to see, what are the appeal options?

However, as others indicated, most likely you won’t be able to sell CBD products on Amazon.

Here we add explanation about our situation.

This is our first Notification from 11.05, after this notification we delete this ASIN from our catalogue.

Yesterday 27.05 we receive this NOTIFICATION:

We contact AHS and they explain to us that the problem is that the product contain CBD and after the phone call they leave us fllowing notification:

Following this notification we prepare this PoA:

We upload this POA using this marks, this is an instruction that we receive by the phone call

And we receive this rejection:

We completed our evaluation of your submission. We do not have enough information to remove the violation at this time.

Is your account still active or not ?

yes it is ACTIVE.
BUT AT RISK, it is in ellow color.
Also, when we speak with the AHS they told me that it will be deactivated if we cannot appeal it succesfully.

Please, post a screenshot of your Account Health page. This will help a lot.

at this moment it is still at risk.

After they reject our POA we contact AH and they say that they need a documents. We prepare SDS and Laboratory Analys.
Contact AH for instruction how to upload this documents and they ask from us to upload both of them in the case (witch one was opened when we ask for a call). At this moment the case is already closed and we still wait for any informaion or answer from AH ot Correct team who check the documents.

We are still able to sell and request disbursment every 24H.

What do you think that we have to do ?

If Amazon rejected your Plan of Action and the account remains At Risk, then I believe the best solution would be to wait for the defect to disappear from your metrics. Just avoid selling any similar products, not to make the matters worse.

Actually I do this.
But during our last call, when they tell me to upload what I have (SDS and Lab Analys), they say that my acc will be deactivated. At this moment we still have no answer. But We have this option:

Yes, you can use this form - tick the boxes and also insert your Plan of Action into the blank field.

Just want to let you know that we decide to wait for answer form amazon. At this moment we still have no answer, continue to sell but only FBA (our own brand) and still succesfully disburse money. Near 2 months after the violation. Hope that after 4 months everything will be ok.
I will write you more information if something happen.

I am sorry to hear that your Seller Account has been deactivated. From the deactivation notice it seems like you continued selling the same products for which you received a violation.

Do you still have any active listings for these products subject to the previous warning?

Because Amazon won’t suspend you as long as you delete all similar listings following the first warning.
