Trademarked logo misuse suspected complaint

I got a Product Policy Compliance ding due to Trademark Logo Misuse. It was for a brand I sell a lot off never had issue - but with this particular ASIN it is affected. It says it has No impact on Account Health Rating. I have deleted the ASIN.

Shall I either

  1. just let it fall off in 180 days.

  2. Submit appeal.

I am hesitant to submit appeal as I sell other items on this brand that have no issues. Is it best to just let it fall of as it has no account health impact

On submitting appeal it says "Why is this happening?

We have taken this measure because we suspect that your listing for this product infringes on the intellectual property of others. The product detail page for this product uses the trademarked logo of another rights owner. We have not been able to confirm that you are authorised to use this trademark on the product detail page. Unauthorised or incorrect use of this trademarked logo is likely to cause confusion as to the source, endorsement or affiliation of the goods. Infringement of a trademark is a violation of Amazon Intellectual Property Policy.

How to address the listing violation?

Your listing is currently either deleted from your inventory “or” inactive “or” not available in the catalogue. To remove this listing violation notification from your Account Health, indicate that you (on behalf of yourself and the business you represent) understand and agree with the statements below:

Making this acknowledgement will remove the listing violation from your Account Health without reactivating your listing. Note that Amazon may terminate the selling accounts of repeat infringers in accordance with the Business Solutions Agreement.

If your account health isn’t impacted, and you don’t need this ASIN back, just let it fall off in 180 days. If you want to be proactive, acknowledge the violation (without appeal).

Since the violation has no impact on your Account Health Rating and you have already deleted the ASIN, the safest approach is to acknowledge the violation without submitting an appeal. This removes the notification while ensuring Amazon sees that you understand and comply with their Intellectual Property Policy. Appealing could draw unnecessary attention to your account and might lead to further scrutiny of your other listings under the same brand. If you plan to relist the product in the future, you may need proper authorization from the brand owner to use their trademark. For now, letting it fall off in 180 days or acknowledging it to remove it from Account Health are both low-risk options, but acknowledging it is the faster way to clear your dashboard.
