Sourcing from Alibaba

Hello all!

If I choose to source products from Alibaba, how do I make sure there are no patents or that I won’t run into any problems when going to list or sell the product?

Secondly, do all products from Alibaba have to be listed under generic? Some of the products on Amazon are exactly the same and you can tell they are from Alibaba but they have different “brand” names but are the same exact product?

I’m just confused on the whole “brand” thing which I’m assuming is different from just slapping your name on a wholesale product?
