Recovery Brand Registry address or open new account

Hello,

We were recently contacted by a company that propose a collaboration contract to sell their products to Amazon Platform.

I asked them if they are registered as a brand, do they have intellectual property rights… and yes they are registered in EUPIO as a brand.
But,
They authorized a former collaborator, since they had no knowledge of the Amazon Brand Registry at that time, to open an account for them in the Amazon Brand Registry.

After some time this former collaborator restricted access to Brand Registry, they denied him access to his own brand, and he uses them to politicize the already existing listings on Amazon as if they were Brand Owner.
This former collaborator started to do a lot of damage to the image of this Brand and that is why they trying to get rid of this former collaborator who also has access to the Brand Registry.

The Brand Owner is asking us to help him recover his brand authority on Amazon.
How do you think he should approach this situation?
Amazon does not respond to emails and neither does the former employee.

I don’t want to sell his products yet because we will surely risk an IP Complaint from bad ex collaborator.

The former collaborator buy their products from distributors, but the brand cannot impose on the distributors who to sell to and who not to.

Thank you

It seems like the brand owner specifically contacted you for a reason, since they are unable to manage their own brand on the Amazon platform. Definitely don’t sell their products prior to this issue being sorted - you are asking to get attacked by the disgruntled former employee. Conflicts between brands, Amazon sellers and their former employees are very common. As you know, Amazon is usually unhelpful and unresponsive.

The best way how to solve this is to let the brand sort it out via legal means. They will need to hire a lawyer to contact the former employee and arrange a resolution.

Don’t get dragged into this as otherwise, what may also happen is that you will invest significant time and resources into trying to resolve the conflict and one everything is solved, the brand will start selling their own products on their own, without cutting their profits by involving you.

I agree with Kika. This seems like a can of worms you’d rather not open.
