Products gated due to your business being located outside of this marketplace

Hello everyone,

I have a European business and want to sell my product (restricted category) on the American market through FBA. However, when I request approval, Amazon Seller Central shows me this message:

“You account does not qualify. We cannot accept your application to sell these products on Amazon due to your business being located outside of this marketplace.”

My inventory is already in a warehouse in the US and was deactivated by Amazon. Does this mean that I would have to create an American business to be activate this ASIN?

Amazon support gives me dozens of conflicting answers - they don’t seem to know themselves.

Unfortunately, Amazon recently introduced new restrictions on numerous popular brands. This means that they will only approve local resellers to sell them. I don’t think that a virtual LLC would help, as they are looking at the director’s country of establishment.

I experienced the same issue and had to remove my stock as well.
