POM restricted product

Hello,

I have been selling this particular beauty product for years. A couple of days ago, I have received the notification stating that The sale of medicines by function or medicines by presentation that are not authorized in Germany or are prescription-only medicines, is not allowed on Amazon.de and removed the product from Amazon.

Despite the fact that we have our products registered to CPNP/SCPN and all corrected information and selling other European marketplaces still on going, only Amazon DE removed this particular ASIN.
I have sent an appeal with the CPNP reg no. and RP contact information but still no luck, the bot keeps saying the same email as “We leveraged a combination of automated means to identify this issue and to make this decision.”

Does anyone have the same issue and reinstate?

I have a particular experience with dealing with Restricted Products in Europe. Many sellers are reaching out to me after having their listings blocked in just one country, such as France or germany, which are the most tricky marketplaces.

Even if you have all the relevant certifications, each of these countries have their own legislations, which can mean that your product cannot be sold only in that specific country, while it is allowed elsewhere.

A prescription-only medicine means that even though it is entirely legal to be sold, it (or its ingredients) requires a prescription, meaning that sales on Amazon are not possible.

To prevent account deactivation, I would advise you to remove any similar products containing identical ingredients from your inventory on the German marketplace in the meantime.

Also, it would be helpful if you reached out to a professional who advises on pharmaceutic products to advise you on the conditions of sale of this specific product / ingredient. Frequently, if the ingredients are switched, the product can be sold afterwards.

I asked this because this specific ASIN falls under a parent ASIN which has two ASINs with variation as in quantity different wise. One is still active.

Yes, with Amazon it is very common that their automated algorithms will only deactivate and enforce one product while leaving similar ones active.

Could you share the ASIN or a link to the product to see if I have any ideas on why the product is restricted?

No. Restricted products never get reinstated automatically. But many sellers get suspended a few weeks after receiving a warning, if they failed to remove similar listings from their inventory.

Even though your product is registered with CPNP/SCPN and complies with other European marketplaces, Amazon Germany might have stricter or differently interpreted rules, especially with their automated systems. A lot of sellers have faced similar issues when it comes to compliance rules varying by marketplace. Since your appeal hasn’t worked yet, you may try providing extra documentation, like proof of product classification or a letter from a regulatory authority, could make a difference. It can take time to get past the automated responses, so stay persistent, hopefully, you’ll get the ASIN reinstated soon!

Thank you for your response.

We get the ASIN reinstated last week thankfully, while the other ASIN still fell under the same parent was active. It took us 2 days to get it back on track again.
