Please help, I’m selling pickleball paddles, but Amazon determined that my listing infringes on someone else’s registered trademark ‘Pickle-Ball’.
I’ve appealed once and it failed.
This is actually a known issue in the pickleball category. Pickle-Ball Inc holds a registered trademark on the hyphenated version of the name and they actively enforce it on Amazon which catches a lot of generic pickleball sellers in the crossfire.
First thing to check is whether your listing title or bullets use the exact trademarked term with the hyphen. If you are using the generic spelling pickleball as one word without the hyphen that is a strong basis for your appeal. In your next appeal be very specific about this distinction and attach evidence showing your copy uses the generic term not the trademark.
If Amazon still does not budge the other route is to contact Pickle-Ball Inc directly and explain you are not selling their branded product. Some sellers have had the complaint retracted this way.
