If an Amazon seller is the only FBA seller (or one of just two) on all their listings, and their Amazon Storefront includes over 100 products across various categories, does that mean they have exclusivity or brand restrictions?
Could jumping on their listings lead to IP complaints?
If a seller is the only FBA seller on a large number of listings across different categories, especially with consistent branding or professional storefront setup, there’s a good chance they either have brand exclusivity, are the brand owner, or have wholesale agreements with distribution restrictions in place. While it’s not always guaranteed that they’ll file IP complaints, jumping on such listings without verifying brand permissions does carry a higher risk of receiving complaints, especially if the brand is enrolled in Brand Registry or if the seller has monitoring tools in place. To be safe, always check for signs of private label branding, trademarks, or restricted distributors before listing the same product, and consider reaching out to the brand for permission if you’re sourcing it legitimately through authorized channels.

If you’re worried, I would check if these sellers own any retail stores, if they do, take a look at their website to see if there’s any mention of that brand.
Second, email the brand and ask for permission to sell on Amazon, but only do this as a last option.
Check their company name on the LTD register or in their license, because many sellers have a different Amazon storefront name and a different registered company name, I do the same.
