I have received an intellectual property complaint

Hello everyone,

I’m looking for guidance on how to address this violation. The item is a beauty product imported from the USA that I sell in the UK, and it has affected my score. There are 10 FBA sellers, and everything looked good. I spoke to Amazon, and they said it’s classified as a parallel import, so the brand has raised this issue. They also suggested I get a letter of authorization from the brand.

I just checked my listing on Amazon, and just yesterday there was a sudden drop in the number of sellers. I doubt the brand will give me a letter of authorization. I’m happy to contact them, but what’s the best thing to do here? Should I ask for a letter of authorization or apologize for selling the product?

I don’t want to acknowledge the complaint yet if there’s hope of getting it removed. I have uploaded an image from today. Just yesterday, the number of sellers went from 90+ down to 40+. Could these 40+ sellers have brand authorization?

Close and delete the listing.

Email the IP issuer, apologize, send the invoice, and ask for an IP retraction.

If none of this works, then I would email the brand and ask for permission to sell in the UK. If they say yes, then I would ask for a letter of authorization (LOA), which I doubt you will get, but there’s nothing to lose.

The problem is, this is a genuine parallel import case—bought from the US and sold in the UK. While I agree with your advice above, I think I might be cautious about going down that route if this is a newer account with lower account health.

If the account health is 400 or 500+, then you can confidently go down the route above, as even if it fails, it’d be healthy enough to take the hit. However, if it’s a new account and the brand owner doesn’t want others selling on the listing, they may choose not to retract it. If I had this on a new account, I might be tempted to at least talk to a specialist about it.

I may be being over-cautious or pessimistic, though.

There are no guarantee that amazon won’t deactivate your account if you have more than 200-300-400-500 points :slight_smile: We were deactivated for a single violation while our entiy european marketplaces were in gree sector :slight_smile: and the violation is with NO IMPACT HEALTH SCORE status

The account is fairly new. Should I not have imported it from the USA? I see your point in being cautious, it has affected my score. It had no sudden drops in the last year, so my initial analysis seemed fine, but I was clearly wrong.

I had this same issue recently, and I’m a new seller, imported from usa sold in UK parallel violation from uk distributor, I sent email like @masud530 suggested no reply, called and spoke to decision maker assistent overly politely explaining human error, new seller, small family business with serious potential problems if not resolved, was retracted after call.

Thanks. I emailed the brand earlier, so let’s wait and see. Calling them is a good idea; I’ll do that and keep the post updated with the outcome. Thanks.
