I got an IP complaint for Patent Violation

I’m doing PL of a very common China product.

Many of the UK sellers are selling the exact same product just by using their own brand name. I have done the same, I clicked to list, just used a unique brand name on my packaging. Other sellers are still selling but I got the IP complaint.

What can I do next? I appreciate your kind advice.

Seems to me if it’s PL with branding, multi sellers selling, makes me wonder if it’s for real.

Some bad players will file IP just to scare you off. Did you get a letter from a lawyer or a well known company? Did you get a cease and desist letter? Have you researched or googled the patent?

The rights claimer kicked out almost every seller who doesn’t have brand registry. But, those have the brand registry, they are still selling the exact same product for which I got IP complaint.

You just need to find someone to do patent check… And than see report for yourself. dont for appeal of anything, first analyze if its authentic issue. If there is a patent in play than it seems you have to strike a deal with patent owner and you have to pay alot to sell this on Amazon like setup fee or monthly fee …something like that

I say ask the complainer to provide you with the registered patent number. If it’s registered then the person complaining should have a registered patent number.

Patent has nothing to do with the brand on packaging. I would recommend legal advice that specialise in patents and can verify if product is patented. Which marketplace?

First, you need to ask whether this product has applied for a patent, and then ask the supplier whether anyone has signed a confidentiality agreement with them for this product.
